Privacy

Your privacy is important at Whitmark Development. This website does not place cookies on your computer nor does this website collect personal information about you. However, we do require your name, email address, phone number, and perhaps machine ID to supply you with the services and products you have requested for invoicing, payment processing and licensing purposes. All invoicing and payment processing is handled by reputable third-parties so you do not have to share your personal financial information with us. Whitmark Development will not disclose your personal information to anyone, for any reason.

Confidentiality

The confidentiality of the business relationship and security of your intellectual property (IP) is of utmost important at Whitmark Development. Successful trading approaches are hard to come by and are often the result of untold hours of intense research and analysis. Any electronic documents, images, or other working documents necessary to develop your trading idea are maintained separately and securely on local servers.

Payment Terms

In most cases, clients who require custom development work will be billed using PayPal email invoice. Small projects will require advance payment while larger projects will require a 50% advance payment prior to the commencement of development work with the balance due 3 (three) days following successful client acceptance testing to be completed within 7 (seven) days unless otherwise specified. Please keep in mind, your payment is for delivered time and expertise to develop your trading idea, and not for the ultimate performance your trading idea. Whitmark Development reserves the right to withhold open source code until full payment is received.

Guarantee of Workmanship

To ensure the utmost in client satisfaction, Whitmark Development will guarantee workmanship against programming defects (“bugs”) for any custom deliverable subject to the specified project scope and terms of use stated below. Whitmark Development offers proficient and affordable means for clients to take advantage of custom development who may not have the skills, knowledge, or time to develop themselves or if they do, prefer not to. However, despite our goal of delivering products that will run error-free long into the future, the reality is there are myriad of technologies at play for any given implementation and therefore, as a practical matter, this guarantee is limited to the delivered work product and is exclusive of:

  • Subsequent upgrades made to the trading platform or data feed / broker interface.
  • Subsequent modifications made by you or others to the delivered code.
  • Application of the deliverable to markets or timeframes for which it was not designed.
  • Identified platform “bugs” or other operating deficiencies confirmed by platform technical support. For conversion efforts, minor and inconsequential operating differences between old and new platforms.

Whitmark Development reserves the right to refuse products and services to anyone for any reason. All material on this website is subject to change at any time without notice.
